Terms and Conditions (GTC) of Mihalca Homes GmbH.

1. scope of application.

These General Terms and Conditions (GTC) apply to all contracts concluded between Mihalca Homes GmbH, Peter-Henlein-Str. 13, 89312 Günzburg (hereinafter "Provider") and its customers. These include, in particular, brokerage contracts, rental contracts and real estate purchase contracts.

2. conclusion of contract.

A contract is concluded as soon as both parties have reached a written agreement. Acceptance can be made in writing, electronically or verbally. The customer agrees to these GTC.

3. services of the provider.

The provider provides the following services:

  • Real estate brokerage (brokerage contracts)

  • Conclusion of rental agreements

  • Real estate brokerage and sales

4. remuneration.

A commission is agreed for the services provided, which is regulated in the contract. The commission is due upon conclusion of the contract.

5. payment
conditions.

The agreed remuneration must be paid within 14 days of invoicing. In the event of late payment, the provider reserves the right to charge interest on arrears at a rate of 5 % above the respective prime rate.

6. liability.

The provider is only liable for damages that are attributable to intentional or grossly negligent breaches of duty. Liability for slight negligence is excluded insofar as no essential contractual obligations are affected.

7. data protection.

The provider undertakes to treat customers' personal data confidentially and to process it in accordance with the applicable data protection laws. Further information can be found in our privacy policy.

8. right of withdrawal.

Consumers have a statutory right of withdrawal. Details can be found in the withdrawal policy.

9 Contract term and termination.

The contract term and notice periods are based on the individual contracts concluded. Unless otherwise agreed, a notice period of three months to the end of the month applies.

10. conclusion
Provisions.

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a provision that comes closest to the economic purpose of the invalid provision.

The place of jurisdiction for all disputes arising from the contractual relationships is Günzburg.
